Queensland’s new premier is a plain-spoken, modest woman with a ‘foreign’ name. She was triumphant after the self-confident three year reign of Campbell Newman. Tony Abbott also did his bit for the Queensland result, as a man of power who characteristically overreaches and is yet to learn the lesson that the right to rule has to be earned, every day, from the people.
Wayne was a no nonsense fellow with a real commitment to justice for Aboriginal Australians during the difficult Bjelke-Petersen days in Queensland. He put himself on the line, and would always come back to the office with a smile and a joke about the latest put down he suffered at the hands of the unforgiving magistrate not much given to pleas invoking past dispossession. Successive Australian Governments have created fictions that aim to exclude asylum seekers. The latest example is the case of Baby Ferouz, whose protection visa application was refused in the Federal Circuit Court last week. Normally, a child born in Australia is considered to have the same visa as their parents. But Ferouz’s parents had no visa, so lawyers in Brisbane arranged for her to apply for a protection visa.
Last week, Immigration Minister Scott Morrison proposed migration law changes that he said would speed up processing of the backlog of refugee claims, and allow asylum seekers to 'get on with their lives'. In fact they do nothing of the sort. The new temporary protection visa (TPV) denies family sponsorship, travel to visit family, and more.

Over the last few years the High Court has made several decisions which found the Government wanting when making decisions regarding asylum seekers. Inevitably the cases are decided on the basis of whether a power was correctly applied or interpreted. Sometimes the results favoured asylum seekers, sometimes they upheld the position of the Government. A case this week in which the applicant lost may have significant consequences.
Australia's cruel arrangement for asylum seekers arriving without a visa cannot be scrutinised by our courts and has never been approved by our Parliament. In the name of democracy, in the name of Australian self-respect, and in the name of human rights protection and the rule of law, it is time this arrangement was presented to our Parliament for its approval by our elected representatives or for immediate ditching. It's a disgrace.
