    As I take in the submissions presented to the Senate inquiry into the Manus Island riots, I am reminded of Gabriel Garcia Marquez' Chronicle of a Death Foretold. In it, nearly the entire town knew of Santiago Nasar's impending death; his assassins had made a point of divulging their intent to everyone they met over the course of the day. The prevailing impression from the Senate inquiry is one of similar inevitability and complicity.

    Australia's cruel arrangement for asylum seekers arriving without a visa cannot be scrutinised by our courts and has never been approved by our Parliament. In the name of democracy, in the name of Australian self-respect, and in the name of human rights protection and the rule of law, it is time this arrangement was presented to our Parliament for its approval by our elected representatives or for immediate ditching. It's a disgrace.

    Budget makes asylum seeker vilification official

    The Government's vilification of people arriving by boat has reached the level where the term 'illegal' features in the Budget documents. Immigration Minister Morrison has insisted on referring to people arriving by boat as 'illegals' for some years, despite the Migration Act using the less pejorative term 'unlawful non-citizen'. This is not just a lawyer's linguistic debate; if it were not important, the Government would not insist on the term.

    Scott Morrison has announced the formation of a powerful new paramilitary force with its own ideology, training and rank structure, answerable only to an immigration minister. There is a disturbing comparison that may be drawn between this new agency, apparently with no legal or constitutional checks and balances outside itself, and the Schutzstaffel security service established by Hitler and answerable only to him as leader.

    Ministers and officials structured on Manus a sustained deterrence scenario intended to be so awful as to choke off the flow of boat people. The impeccable logic of the plan reflects the logic of psychopathy. Psychopaths are highly intelligent, good planners, manipulative, with expert knowledge of human nature, yet lacking in empathy. Whatever their motivation, the planning of the Australian ministers and officials ticks all these boxes.

    'We should abandon talk of taking Australia off the table. We should also abandon talk of taking the sugar off the table. The collateral damage of that is too great. The best we can do ethically and practically is to put the sugar out of reach while leaving it on the table for those who make it here with a visa or in direct flight from persecution.'     Despite presenting the end of taxpayer-funded immigration advice to 'illegal boat arrivals' as a cost-saving measure, Scott Morrison's announcement demonstrates once again the Government's policy of punishment for those who come on boats without a visa. As an immigration lawyer who does not do any cases that are government funded, in theory I should applaud this decision, as it means possibly more clients. Instead I am appalled.

    Labor needs the Liberal Left

    In a party in which conservatives are dominant, life is rarely easy for centrist Liberals. They are a cultural minority within their own party and can be criticised for rocking the boat when their party is on a roll. Those who are further to the left, including Labor and the Greens, should not just hope that the Liberal Left is heard loud and clear, but they should respect and nurture this strand of liberalism.
