Whoever is Prime Minister after the election on May 21, he will need to address the question of Indigenous recognition in the Australian Constitution. This is the sixth election in a row when the question has been a live, unresolved issue during the election campaign. The patience of Indigenous leaders is understandably wearing thin. Trust is waning. There is still no clear path ahead. So where to from here?
If our governments fail to roll out frameworks of good governance when times are good, they cannot expect to have the trust of the people during a crisis. So long as Australia fails to enter into proper legal relations with Aboriginal and Torres Strait Islander peoples, we will see protests, and ‘agitators’ will continue to call for justice.
With idealism and pragmatism, I invite you criminal lawyers in the next 30 years to imagine and enact a better criminal justice system which alleviates rather than exacerbates the devastating effects of colonisation and marginalisation on Indigenous Peoples, and most particularly their children. An intelligently designed criminal justice system must help secure the foothold of Indigenous children in both the Market and the Dreaming.

We need clever strategic and moral thinkers among our health professionals, who can engage with the demands of an aging population, with the gap in life-expectancy between Aboriginal and non-Aboriginal Australians, and with the increasingly politically correct debate about euthanasia.

Good intentions are not enough. Gone should be the days when Aboriginals are marginal to the corridors of power. Perhaps it will not be until we have seen the first Aboriginal Prime Minister that agitators for Indigenous justice will be vindicated.
Too often, generic statements about missionaries colluding with colonialism and destroying indigenous cultures are presumed to say all that needs to be said. Detailed study of mission history is essential if we are to move beyond the clichés.
