So-called people smugglers are often penniless teenagers who are simply a link in the chain for those who are seeking legitimate asylum. The Government's new retrospective law will punish such individuals for an act that was legal at the time it was committed.
Yesterday the Government announced it will change the Migration Act to enable the Malaysia solution to go ahead. This latest action reinforces rhetoric about queues and people smugglers that obscures the real effects and motivations of current asylum seeker policy.
From now on, the High Court will apply a very fine tooth comb to any legislation allowing ministers to ship asylum seekers offshore. Unless there were to be a bipartisan agreement in the Parliament or a government deal with the Greens, asylum seekers arriving by boat now need to be processed fairly, promptly, on our terms and on our turf.
At least adults have a little hope of understanding the pain, and coping with it. Even the most equable of children must find the experience bewildering at best, and agonising at worst. My eldest son had a period of not eating. His migration as a child remains the defining fact of his life.

It is impossible to explain how one human being can make plans to kill and maim others, and coldly carry them through. Everything suggests the perpretrator of the killings in Norway had imbibed ideas that showed no respect for empathy with people as unique individuals.
The Malaysian solution is unprincipled, but it might just work — stopping the boats. If other countries try to replicate it, we will have to tear up the Refugee Convention and start again. And the plight of unaccompanied minors transported from our shores to Malaysia will be on our conscience.
Even if the Malaysian government guaranteed the security, sustenance and education of the asylum seekers, the human dignity of those found to be refugees would still be significantly infringed. They would be unable to enter Malaysian society equally, and they have no possibility of prompt acceptance into another society.
Officially, the ban on journalists interviewing or filming asylum seekers in detention is for the detainees' protection. But it also stops them from sharing their stories with the public. Surely asylum seekers are capable of determining who is and is not acting in their best interests.
My sons had their bedtime stories for years, but had to become used to my saying 'Just a minute' while I raced to the end of a page or chapter. Now grown, my technophile youngest had a most surprisng reaction to the marvellous present sent to me recently.
