    Cambodia's patchy refugee record

    In 2009 Cambodia enacted its own laws concerning refugees. If asylum seekers are found to be refugees they are given a prakas that allows them to stay legally in Cambodia but which is not accepted as a proof of identity by most employers, businesses and banks. The sense of insecurity of those seeking asylum is heightened by the memory of the 29 Uighur asylum seekers who in 1995 were deported from Cambodia to China at gun point.

    High Court backs ministerial power over asylum seekers

    Over the last few years the High Court has made several decisions which found the Government wanting when making decisions regarding asylum seekers. Inevitably the cases are decided on the basis of whether a power was correctly applied or interpreted. Sometimes the results favoured asylum seekers, sometimes they upheld the position of the Government. A case this week in which the applicant lost may have significant consequences.

    It's time Parliament had a say on 'disgraceful' PNG solution

    Australia's cruel arrangement for asylum seekers arriving without a visa cannot be scrutinised by our courts and has never been approved by our Parliament. In the name of democracy, in the name of Australian self-respect, and in the name of human rights protection and the rule of law, it is time this arrangement was presented to our Parliament for its approval by our elected representatives or for immediate ditching. It's a disgrace.

    Is our morality at sea with the refugees?

    'We should abandon talk of taking Australia off the table. We should also abandon talk of taking the sugar off the table. The collateral damage of that is too great. The best we can do ethically and practically is to put the sugar out of reach while leaving it on the table for those who make it here with a visa or in direct flight from persecution.'     Count the cost of refugee legal aid 'savings'

    Despite presenting the end of taxpayer-funded immigration advice to 'illegal boat arrivals' as a cost-saving measure, Scott Morrison's announcement demonstrates once again the Government's policy of punishment for those who come on boats without a visa. As an immigration lawyer who does not do any cases that are government funded, in theory I should applaud this decision, as it means possibly more clients. Instead I am appalled.

    The BBC's John Humphrys admonished Julie Bishop over the Coalition Government's off-shore processing centres, which he said 'have been described as 'breeding grounds for rape, riots, malaria and mental illness, that bear the look of concentration camps'. Alice Herz-Sommer, believed to be the oldest survivor of the Holocaust, died recently in London. Her story contains salient lessons for Australia's border protection regime.

    China’s asylum hypocrisy

    This week China criticised Australia's treatment of asylum seekers. The criticism, raised at a bilateral human rights dialogue, is good politics: China is using Australia's cruel and inhumane asylum policy as diplomatic leverage. Nevertheless, it is astounding hypocrisy from a country that returns refugees to danger, including to North Korea, a state infamous for its widespread violations of human rights.

    Most people will not miss Mark 'Chopper' Read, because of his reckless attitude to human life and law and order. Yet his ability to remain master of his own destiny makes him in that sense a positive role model for today's prisoners. Other poor people and asylum seekers who are able to rise above their circumstances can contribute positively to public wellbeing.

    Seven pointers for stopping the boats ethically

    Last Tuesday, seven West Papuan asylum seekers reached Boigu Island in the Torres Strait. Without any determination of their refugee claims, they were removed to PNG. They were not engaged in secondary movement, they were in direct flight from persecution. The Abbott Government should recommit to our obligation under the Refugees Convention to grant asylum to refugees who have entered Australia in direct flight from persecution.
