    We Australians confront none of the complexities of sharing a land border with a poor neighbour. Most Americans, I find, consider our policy morally repulsive and just stupid. They cannot believe that we routinely lock up children, that we recently held 157 people on a ship in the Indian Ocean for almost a month, and that we are now going to send up to 1000 asylum seekers to Cambodia.

    Liberal democracies keep secrecy in check. Where secrecy is justified, this justification should itself be public. The Abbott Government has withheld important information from the public on questionable grounds, and it has shielded itself from criticism by stifling debate on whether that secrecy is justified.

    While the Federal Government continues to cast around for other Pacific nations and Cambodia to take in refugees held on Manus Island and Nauru, it has one ready solution right on its own doorstep. It is a place that has been calling out for help to counter its falling population and its prolonged economic crisis. It is an Australian territory and one that is already receiving Australia's financial support.

    Like the Dictation Test devised devised to enforce the White Australia Policy, the National Interest Test would allow the Minister to exclude anyone he wanted. People who claim protection can be confident that the Australian Government will not have them or their dogs killed, but they will have no confidence that they will not be placed in dangerous situations or returned to places where they fear for their lives.

    Tamils facing new atrocities in Sri Lanka

    On Monday we learned that two boats of Tamil asylum seekers had been intercepted off Christmas Island. Now there are unconfirmed reports that Australia is handing them over to the Sri Lankan navy without assessing their claims for protection. Amnesty warns Tamils face the risk of sexual violence, torture, murder, imprisonment, and enforced disappearance. Since March this year there have been scores of arrests and several deaths.

    As I take in the submissions presented to the Senate inquiry into the Manus Island riots, I am reminded of Gabriel Garcia Marquez' Chronicle of a Death Foretold. In it, nearly the entire town knew of Santiago Nasar's impending death; his assassins had made a point of divulging their intent to everyone they met over the course of the day. The prevailing impression from the Senate inquiry is one of similar inevitability and complicity.

    Australia's cruel arrangement for asylum seekers arriving without a visa cannot be scrutinised by our courts and has never been approved by our Parliament. In the name of democracy, in the name of Australian self-respect, and in the name of human rights protection and the rule of law, it is time this arrangement was presented to our Parliament for its approval by our elected representatives or for immediate ditching. It's a disgrace.

    Budget makes asylum seeker vilification official

    The Government's vilification of people arriving by boat has reached the level where the term 'illegal' features in the Budget documents. Immigration Minister Morrison has insisted on referring to people arriving by boat as 'illegals' for some years, despite the Migration Act using the less pejorative term 'unlawful non-citizen'. This is not just a lawyer's linguistic debate; if it were not important, the Government would not insist on the term.

    'We should abandon talk of taking Australia off the table. We should also abandon talk of taking the sugar off the table. The collateral damage of that is too great. The best we can do ethically and practically is to put the sugar out of reach while leaving it on the table for those who make it here with a visa or in direct flight from persecution.'     Count the cost of refugee legal aid 'savings'

    Despite presenting the end of taxpayer-funded immigration advice to 'illegal boat arrivals' as a cost-saving measure, Scott Morrison's announcement demonstrates once again the Government's policy of punishment for those who come on boats without a visa. As an immigration lawyer who does not do any cases that are government funded, in theory I should applaud this decision, as it means possibly more clients. Instead I am appalled.
