The 4 Corners report into the treatment of children in a NT juvenile justice facility is a stark and grotesque demonstration of state abuse of power. As a result John Elferink, NT Corrections Minister, has been sacked, and the Prime Minister has announced a royal commission into the actions at Don Dale. This is a good start, but there is much more to be done. We need to question a culture that willingly imprisons the most vulnerable, and puts up with a system where not all are equal before the law.
It is one thing to sit at a desk and make policies that will impact on individuals across the sea whom you do not know. It is another thing to cross the sea, to look into the eyes of people abandoned there, to meet the children and see the pictures they have drawn, and to see in their eyes terror, despair, depression and contempt. For a prime minister to go to Manus Island would require him to throw off the shroud and stare affrighted at the maggots in the flesh of the body politic.
With PNG's Supreme Court finding last month that the detention of asylum seekers on Manus Island was unconstitutional, the shamefulness of Australia's border protection policies was once again laid bare. Advocates will be familiar with the facts and arguments that Chasing Asylum articulates. What sets it apart is its wealth of hidden camera footage caught within the grim confines of the centre on Nauru, and Orner's conversations with detainees and social workers who bore witness to the dire daily reality there.
I talk to those on Manus at all times of the day and night and make sure they are okay. Of course, they are not okay, but so far all of my friends are still alive We keep their spirits up by sending them clothes, games and keeping their phones paid-for so they can talk to their families. We keep them informed about what is going on in Australia. We do not encourage them to hurt themselves in order to put pressure on the government. We do everything possible to stop them from hurting themselves.
In democracies, public sentiment is meant to be taken seriously. Describing something as populist is a refusal to engage with the sentiment, including its source and complications, usually because we find it disagreeable. The subtext is: people are wrong about the things they care about. They are not being rational or realistic. It is a brave thing to say these days about support for a royal commission into banks, or softening public attitudes toward detention-bound children.
A bench of five justices of the Supreme Court of Justice, the highest court in Papua New Guinea, has unanimously ruled that the detention of asylum seekers on Manus Island is unconstitutional. Yet again, Australia has been complicit in its Pacific neighbours (PNG and Nauru) prostituting their Constitutions and undermining the rule of law in exchange for a fistful of dollars, with hapless asylum seekers, most of whom are ultimately proved to be refugees, being left to languish.
The royal commission into Aboriginal deaths in custody, which signed off on its final reports 25 years ago this Friday, definitely improved the systems for supervision of persons in detention, reducing the risk of deaths in custody. It also led to better coronial procedures. But it failed to reverse Indigenous imprisonment rates and it did little to counter the underlying causes of Indigenous imprisonment. Back then, Patrick Dodson saw police as the main problem. Now, he thinks it's the legislators.
We got a lesson in the art of language from the Minister of Immigration, Peter Dutton, whose redefinition of the word 'detention' was reminiscent of Humpty Dumpty's remark in Alice Through the Looking Glass: 'When I use a word it means just what I choose it to mean, neither more nor less.' We are social creatures who make real decisions based on the representations of others. Once we know we cannot expect the truth from each other, especially those who govern, society can no longer function.
The Palm Sunday Refugee Marches have come and gone; the travails of people who seek asylum continue. In a recent article that reflects her rich experience, Moira Rayner was right to say that marches are not effective in changing policy. Where they are, as in the Vietnam War marches in Australia or in Manila under Marcos, the fortress was already crumbling. Yet even when they are not effective, marches are not a waste of energy. Their value lies not in their effectiveness but in their ritual.
If we are to make institutions safe for children, we need not only hold to account people who have presided over unsafe places, but also to address a culture that protects silence at each level of organisations, preventing complaints being made and being reported. Clergy and celebrities must not be treated as different from others, entitled to have their bad behaviour ignored. They must be held accountable to the officers and regulations of the organisation in which they work.
It is right and good that the outpouring of community and professional goodwill has at least delayed the return of baby Asha to what are reported to be the terrible conditions of the detention centre on Nauru. But Australia's asylum seeker laws involve unresolved systemic issues that such wins cannot by themselves resolve. Widespread community focus on individual cases such as that of baby Asha may in fact prevent action on the deeper issues from gaining traction.
