In Unheard Story, Fr Padraig McCarthy rightly highlights shortcomings in legal-political-media processes like the Dublin Archdiocese Commission of Investigation. The future wellbeing of children demands that the spotlight be shone on all equally. But there is no getting away from the fact that in Ireland and Australia, the reported instances of child sexual abuse has been greater in the Catholic Church than in other churches.

As an institution, the Catholic Church has been dragged kicking and screaming. Cardinal Pell has been put through the wringer, though admittedly nowhere near to the same extent as was John Ellis when the Church decided to unleash the legal attack dogs on him in litigation which was euphemistically described as vigorous and strenuous.

Economics is full of circular arguments. The Government is on the one hand arguing — most notably with the SPC Ardmona case, the exit of the car manufacturers and Qantas — that it will not get involved in supporting Australia's industry base. But then it argues that its policies will boost Australia's industry base. Lower unemployment will inevitably follow. For the first time ever it is apparently possible to have it both ways.

The immediate responsibility for this looming economic disaster rests with the Abbott Government, and not merely because of its use of a bullying speech in Parliament by the Treasurer, Joe Hockey, to goad Holden into announcing a decision that its masters in Detroit had probably already taken. In the longer term, this should be seen as a bipartisan disaster. What happened this week was the culmination of a process that began under Hawke.

From a liberal perspective the use of public money to fund free legal services to individuals is inherently undesirable. Even if the contracts are awarded under competitive tendering, the funding of the services is a distortion in the market. Ideally they should be left to the market to provide. And by definition they are less efficient than commercial organisations disciplined by a free and competitive market.

'The Church should not give any appearance of hiding behind the corporate veil. Justice demands that present church leaders agree to satisfy any judgment debt against their predecessors or their deceased predecessors' estates when there is an allegation of past failure to supervise or adequately investigate a sexual predator in the ranks. As a specially selected group of cardinals prepares to meet with Pope Francis, there is eagerness among the world's press for access to the meeting and clear expectations of radical shifts in church policy. 'The Towards Healing protocol is not a substitute for criminal prosecution of sex abusers. Nor is it a cheap alternative to civil liability for damages. It is a procedure available by choice to victims in addition to criminal prosecution of perpetrators or pursuit of civil damages for negligence by church authorities.' Although community organisations are often a burr in the saddle of a managerially minded government, they are important because they represent a humane vision and because they can reflect back to government an intimate experience of what is happening to the people whom they serve. Their advocacy, even when unwanted, keeps governments in touch with human needs.
