While all Australians should enjoy religious freedom, they also bear the right to non-discrimination and to the highest attainable standard of health. It is also unclear how positive discrimination is related to practising a religion.

This indicates to LGBT Christians that they are anomalous, tolerated at best, and to same sex attracted young people raised in faith traditions that they must choose between their sexual orientation and their faith.

But far from concern about settler Australia's moral legitimacy, Aboriginal and Torres Strait Islander peoples seek treaty as recognition of their political difference. Treaties on these terms are unlikely to be acceptable to the settler state.

Gay Muslims are mostly rejected by the Muslim community for being gay and stigmatised by the wider community for being Muslim. Many cannot reconcile the two identities.
