Liberal democracies keep secrecy in check. Where secrecy is justified, this justification should itself be public. The Abbott Government has withheld important information from the public on questionable grounds, and it has shielded itself from criticism by stifling debate on whether that secrecy is justified.

The majority of Australians voted for a government strong on border protection. Immigration Minister Scott Morrison is delivering in spades, so it seems they're prepared to turn a blind eye to disputed claims of child neglect, even if he is their legal guardian. Their only hope is that accounts of their suffering will gain the kind of exposure and momentum that led to the Royal Commission into Institutional Responses to Child Sexual Abuse.

While the Federal Government continues to cast around for other Pacific nations and Cambodia to take in refugees held on Manus Island and Nauru, it has one ready solution right on its own doorstep. It is a place that has been calling out for help to counter its falling population and its prolonged economic crisis. It is an Australian territory and one that is already receiving Australia's financial support.

The implications of the Good Samaritan story are clear on Christmas Island. The evil of child imprisonment is of the Government's own doing, and it must be shamed into remedying it. Is the Catholic Education Office in Western Australia right then to provide education to these children? Catholic agencies that alleviate the harm done to those imprisoned should also make clear their condemnation of the evil of that imprisonment.

While Immigration Minister Scott Morrison sits with Sri Lankan President Mahinda Rajapaksa and hands over customs vessels to the Sri Lankan Government for use in preventing people escaping Sri Lanka, Australia's High Court is deciding whether a group of 158 Sri Lankan asylum seekers can be returned to the Sri Lankan Government. How did we get to the stage where we are supplying the alleged persecutors with the means of stopping people from escaping and seeking our protection?

Australians are understandably shocked at the sentencing of Peter Greste in Egypt. They may wonder what the Government can do for those caught up in the vagaries of a foreign legal system. The answer is, not much. The international order is still largely based on national sovereignty. We do not need to look to Egypt to see how this can allow a multitude of injustices to go unpunished — we need only ask our neighbours, the Indonesians.

As I take in the submissions presented to the Senate inquiry into the Manus Island riots, I am reminded of Gabriel Garcia Marquez' Chronicle of a Death Foretold. In it, nearly the entire town knew of Santiago Nasar's impending death; his assassins had made a point of divulging their intent to everyone they met over the course of the day. The prevailing impression from the Senate inquiry is one of similar inevitability and complicity.

Australia's cruel arrangement for asylum seekers arriving without a visa cannot be scrutinised by our courts and has never been approved by our Parliament. In the name of democracy, in the name of Australian self-respect, and in the name of human rights protection and the rule of law, it is time this arrangement was presented to our Parliament for its approval by our elected representatives or for immediate ditching. The Government's vilification of people arriving by boat has reached the level where the term 'illegal' features in the Budget documents. Immigration Minister Morrison has insisted on referring to people arriving by boat as 'illegals' for some years, despite the Migration Act using the less pejorative term 'unlawful non-citizen'. This is not just a lawyer's linguistic debate; if it were not important, the Government would not insist on the term.

There is a disturbing comparison that may be drawn between this new agency, apparently with no legal or constitutional checks and balances outside itself, and the Schutzstaffel security service established by Hitler and answerable only to him as leader.

Ministers and officials structured on Manus a sustained deterrence scenario intended to be so awful as to choke off the flow of boat people. The impeccable logic of the plan reflects the logic of psychopathy. Psychopaths are highly intelligent, good planners, manipulative, with expert knowledge of human nature, yet lacking in empathy. Whatever their motivation, the planning of the Australian ministers and officials ticks all these boxes.

'We should abandon talk of taking Australia off the table. We should also abandon talk of taking the sugar off the table. The collateral damage of that is too great. The best we can do ethically and practically is to put the sugar out of reach while leaving it on the table for those who make it here with a visa or in direct flight from persecution.'
