Listening to the media and our church leaders in recent days, we know that there is plenty of darkness ahead for our Church in the weeks ahead with the Royal Commission's so-called 'Catholic wrap-up'. We're told that the statistics will be terrible and we expect that some of our church leaders will appear, looking stunned and helpless. This morning, I think we need to reflect on these stark realities in the light of the scriptures. And this can be done only by holding the victims clearly in focus.
For many years I felt that by changing the date we might come to a more inclusive national celebration. However the past few years of Indigenous activism have left me cynical. The things we were fighting for decades ago are very similar to the things we're still fighting for. Australia has not acknowledged and rectified its history; rather it seems content to reinforce its amnesia. It's therefore unlikely I will be able to stop protesting this celebration, regardless of the day it's held upon.
One distinctively Catholic practice is personal confession in which an individual confesses to God their sins and seeks forgiveness in the presence of and at the hands of a priest. Some groups and individuals are proposing to the royal commission that the seal of the confessional no longer be inviolable. I was quoted in The Australian saying, 'If a law is introduced to say that a priest should reveal a confession, I'm one of those priests who will disobey the law.' Being also a lawyer, let me explain.
One of the weaknesses in our society is its lack of effective regulations governing the marketing and availability of alcohol. A second is the ready availability of pornography, as many young men learn how to behave towards women from sadistic and explicit pornography. In the case of the lack of restrictions on the availability of both, churches concerned to respond to domestic violence will need to meet the libertarian objections to regulating profitable business and individual behaviour.
Cultural totalitarianism, embodied in Trump in the US and Hanson in Australia, is a major injustice of our age. To fight it effectively, we have to enter into coalitions with those whose opinions we otherwise find distasteful. An anti-racism rally with only leftwing speakers is not going to make as big an impact as one with speakers across the spectrum. To insist the fight against racism is necessarily a leftwing issue is in some ways its own form of cultural bigotry.
With idealism and pragmatism, I invite you criminal lawyers in the next 30 years to imagine and enact a better criminal justice system which alleviates rather than exacerbates the devastating effects of colonisation and marginalisation on Indigenous Peoples, and most particularly their children. An intelligently designed criminal justice system must help secure the foothold of Indigenous children in both the Market and the Dreaming.
Australia's policy is unique and unrepeatable by other nations because it requires that you be an island nation continent without asylum seekers in direct flight from the countries next door and that you have access to a couple of other neighbouring island nations which are so indigent that they will receive cash payments in exchange for warehousing asylum seekers and proven refugees, perhaps indefinitely. The policy over which Turnbull presides is not world best practice. It's a disgrace.

On 26 July this year of 19 severely disabled residents were massacred as they slept in their beds at a residential care facility in Sagamihara, Japan. A further 26 were wounded. The perpetrator, Satoshi Uematsu, a former employee sacked for his disturbing views about the residents, later boasted of his 'achievements': 'It is better that disabled people disappear.' Isn't there an ever present probability that without an inclusive and accepting community, without believing in our possibilities rather than seeing only our limitations, we will spawn the likes of another Satoshi Uematsu here?

Holocaust survivor Primo Levi wrote If This is a Man to carry out what he saw as the critical task of bearing witness, and he became one of the greatest writers of the 20th century as he continued to bear witness one way and another in later books. Some day, one of Australia's asylum seekers will, like Levi and with the same sense of dread and horror, tell his or her story to ensure that someone bears witness; and to confirm that all of us are implicated.
