    No matter how the Government paints the canvas, it can never be in the best interests of an unaccompanied minor who is a refugee to be removed from Australia to Malaysia. And if such kids are irremovable, they will continue to arrive in Australia by boat.

    From now on, the High Court will apply a very fine tooth comb to any legislation allowing ministers to ship asylum seekers offshore.  Unless there were to be a bipartisan agreement in the Parliament or a government deal with the Greens, asylum seekers arriving by boat now need to be processed fairly, promptly, on our terms and on our turf.

    The Malaysian solution is unprincipled, but it might just work — stopping the boats. If other countries try to replicate it, we will have to tear up the Refugee Convention and start again. And the plight of unaccompanied minors transported from our shores to Malaysia will be on our conscience.

    An old legal maxim is 'hard cases make bad law'. Maybe complex cases compromise policy. Refugee law and policy is complex and the Malaysian agreement signed this week is another example of a compromise on human rights principles for political expedience.

    Even if the Malaysian government guaranteed the security, sustenance and education of the asylum seekers, the human dignity of those found to be refugees would still be significantly infringed. They would be unable to enter Malaysian society equally, and they have no possibility of prompt acceptance into another society.

    Woomera, 2001. It's late, and we've been working for days. I give the detainees' children highlighters to draw with; unknown to me, one of them draws on the office wall. The next day an officer from the camp accosts me. 'This is damaging government property. Someone will have to pay for it.'

    We now know that, in the name of the US alliance, our Government attempted to scuttle the significance of the UN Convention on Cluster Munitions. Thus far the Greens are the only party to take the point, and the only party in full sympathy with the Vatican on this issue.

    Groups concerned for asylum seekers are now faced with bad Australian policies on asylum seekers like the regional processing centre and a harsher regime of detention. They should reject the policies but cooperate with governments to minimise the harm caused to asylum seekers by them.
