'The Towards Healing protocol is not a substitute for criminal prosecution of sex abusers. Nor is it a cheap alternative to civil liability for damages. It is a procedure available by choice to victims in addition to criminal prosecution of perpetrators or pursuit of civil damages for negligence by church authorities.' Unlike their male counterparts, 'delinquent' girls who ran away from dangerous environments were frequently incarcerated because it was perceived that they might be sexually active and fall pregnant. Their stories demonstrate the wide-ranging effects of ruptured family life and subsequent institutionalisation, and warn against the future unnecessary incarceration of vulnerable youth.

Discussion of whether Ned Kelly and Lance Armstrong are heroes or villains is a distraction from the more important big picture reality such as crime and justice in 19th century Victoria, and performance enhancing drugs in sport today. If we are preoccupied with judging behaviour, we will miss the opportunity to promote better laws that will make our society fairer for all.

What is to be done in the name of law and justice for the victims of abuse? Clearly the Church cannot be left alone to get its house in order. The State may have a role to play, but our elected politicians need assistance from lawyers committed to justice, not lawyers acting primarily to protect or condemn the Church.

Australia is seeing a divisive battle between those who oppose people being forced into sex work, and those who advocate for the right of people with disabilities to access sex workers. It is hard to see justice in a situation where one disadvantaged group needs to stay disadvantaged in order to service another disadvantaged group.

Most, if not all priests, would prefer to go to jail than disclose material from confession. The seal of the confessional is a red herring when it comes to protecting children. If confessional reporting were mandatory, chances are that the perpetrator would simply not come to confession.
