With idealism and pragmatism, I invite you criminal lawyers in the next 30 years to imagine and enact a better criminal justice system which alleviates rather than exacerbates the devastating effects of colonisation and marginalisation on Indigenous Peoples, and most particularly their children. An intelligently designed criminal justice system must help secure the foothold of Indigenous children in both the Market and the Dreaming.
The best writers on sport show that it is a metaphor for life. Perhaps that is why the triumph of the Western Bulldogs in the AFL Grand Final has been so ruthlessly milked for larger significance. But I would like to exploit it once more for the way in which it illustrates the weakness of a liberal politics that assumes that all will benefit from the economic growth that unfettered competition between individuals yields. The joy of the Western Bulldogs victory lay in its challenge to these assumptions.
Who owns a cultural object? Who has the right to determine cultural values? And how can public institutions exercise cultural responsibility? It's a timely set of questions as we consider the implications of the National Gallery of Australia's return of ancient Indian sculptures, the British Museum's refusal to return Indigenous objects, or Lionel Shriver's rejection of minority cultural identities. Each of these unleashes complex, painful consequences that can undermine cultural value or cultural safety.
I had been in WA for exactly a year when the local newspaper reported that a white guy had led about 200 people off Wave Rock station. Coming out of the comfortable myth that my home country of New Zealand was not racist, I was amazed to learn that Australia's Indigenous people were obliged to work without industrial protections. The neoliberal right is losing political power to the populist right, which isn't filled with the same ideological zeal for free-market capitalism. Suddenly debates can expand beyond the narrow confines of economic growth. Moral and social arguments won't be relegated to the intellectual fringes anymore. Mainstream parties of the left and right, both of which bought into the neoliberal agenda, will have to break their bipartisan dismissal of discontent with the side effects of globalisation.
Until the 1940s, bodies of deceased Aboriginal and Torres Strait Islander people were sent to museum, scientific, and private collections around the world. The remains of more than 1000 Aboriginal and Torres Strait Islander Australians continue to be held overseas in collections. Indigenous Australians have worked tirelessly towards repatriation, and there has been some success in recent decades. Unfortunately, the remains tend to fall into a grey area of Australian law.
Pope Francis is determined to highlight the opposition of Christian social thinking to the tenets of neoliberalism or market fundamentalism, an ideology which assumes that free markets of themselves will produce the best outcome, and which pushes aside considerations of social or distributive justice. It is unlikely Francis would be waving the flag of social justice so boldly on the world stage had Pope Leo XIII not written his famous social manifesto, Rerum Novarum, 125 years ago.
Historically, having a largely home-owning population has ensured both the social benefit of housing, and an economic benefit through enforced saving with long-term growth. In contrast, the negative gearing push splits the cultural and economic meaning of home ownership, because it focuses on investment. Negative gearing promotes property ownership but not home ownership. Thus the social benefits of home ownership that we have come to expect give way to bare economic indicators.
In the face of the increasing environmental destruction legally occurring within Australia's borders, chasing actors Johnny Depp and Amber Heard for bringing their undeclared dogs into Australia in breach of biosecurity laws comes across as a curated media stunt. Like everywhere in the world, Australian environmental law is at a crossroads. On one hand government regulations that permit violence against habitat increase, and on the other, legal challenges against this destruction rise.
Three finance-related events are currently gaining great attention in the media. One is the so-called Panama Papers. Another is the proposal to have a royal commission into the banks. And a third is the furore over the unaffordability of homes and the debate over negative gearing. On the surface they would seem to be quite separate issues. But all three issues demonstrate yet again that banks are, if not the most malign organisations on the planet, then certainly among the most dangerous.
When we talk about the 'housing crisis' we are often referring to the plight of young working people and migrants struggling to tap into a property market that has been made a prestige market. This has been incentivised by tax breaks for investors, and is symptomatic of the culture of hoarding family wealth for the purpose of passing down class privilege. The Bendigo Street occupation reminds us that the 'housing crisis' is one and the same as the homelessness crisis; not a crisis of scarcity, but of policy.
