    I am deeply saddened at the passing of inspirational actor, storyteller, artist, potter, musician Uncle Jack Charles. I loved him. I was one of the many who loved him. He was a gentle, loving, big-hearted man, despite it all. Because of it all. He triumphed over institutional racism, the legacy of colonialism, and the immense suffering, fragmentation, and trauma it left in its wake.

    My son’s Athenian flat was burgled last month. I had been visiting Athens for the first time in more than a year, and so was with the family when they arrived back, after a fairly brief evening absence, to sheer chaos. Anybody who has had this experience will be able to picture the scene: every drawer and cupboard had been opened, with the contents spilled and strewn everywhere. Even the loft had been checked.

    As immigrants settling in Australia, the relative lack of fences and security measures was a sign that we'd chosen a safe and respectful country. This erasing of margins implied at once both mutual trust and an innate respect for the invisible boundaries that demarcated people's personal space. But 13 year later, I'm noticing the emergence of fortified residences boasting shiny black fences and firmly shut gates.

    The WA premier plans to increase mandatory prison sentences for burglars. Mandatory sentencing regimes fail to take into account the underlying causes of the crimes they seek to punish. They remove a judge’s discretion to avoid a sentence of imprisonment, and fail to address the reality that such crimes reflect social problems that ensue from racial discrimination and colonial dispossession.

    I had anguished over a particular sentence which was the subject of days of media comment. One of my fellow judges stuck his head around the door and said, 'Neil Mitchell says you are right.' This I found unsettling. Then he added, 'But don't worry, Derryn Hinch says you are a disgrace.' Phew!
