    The stats are chilling. The rate of homelessness in the Northern Territory is 12 times the national average. Six per cent of all Territorians are experiencing homelessness. More than 16 per cent of Territorians under 16 are homeless. Twenty per cent of Aboriginal people in the NT are homeless. It's time to do something.

    Last week the Federal Court granted an interim injunction to a child born in Australia preventing her removal from Australia. The case raises complex issues regarding the statutory bars preventing asylum seekers from even making any application at all, and the exercise of the ministerial discretion to lift that bar.

    Former Immigration Minister Senator Chris Evans once expressed concern about how much personal power was vested in his position when making decisions about particular cases. The current Minister, on the other hand, is trying to increase the number of such powers, and is much more likely to use the ministerial trump card to avoid judicial scrutiny. In a parliamentary system that relies on the checks and balances between the Parliament, Executive and Judiciary, one arm of government should not be able to overrule another.

    Is our morality at sea with the refugees?

The best we can do ethically and practically is to put the sugar out of reach while leaving it on the table for those who make it here with a visa or in direct flight from persecution.' Justice Palmer sets about rewriting the law in radical ways, freeing mining companies from regulation and approving disbanding the Australian Greens. Surely such an appointment could be challenged?     In 2001, a Pakistani man granted refugee status set himself on fire outside the Australian Parliament House. Visas for his wife and three daughters had been rejected because one daughter had cerebral palsy. While immigration policy has since become less discriminatory towards people experiencing disability, important barriers still remain.

    Looking at a map of the Australian coastline gives no clue about how far Australia's territorial claims extend. As a result, Australian policy makers aren't eager to embrace suggestions that Asian countries disputing possession of small islands and rocky outcrops should resolve their differences by assigning ownership to the closest country.

    The Department of Immigration and Citizenship say they can't tell me anything. The Inspector General of Intelligence and Security tells me to contact DIAC. As an immigration lawyer I find this frustrating. How much worse must it be for asylum seekers kept in detention with no end in sight?
