The continued persecution of Tamils has led to many fleeing Sri Lanka over the past ten years, with some landing on Australia’s shores — they have literally fled for their lives. The Australian government’s response to the inhumane treatment of refugees returned to Sri Lanka has been to praise the Sri Lankan government’s efforts to thwart any asylum seeker attempt to leave Sri Lanka.

If society were a mine, refugees would be the canaries in it. Their condition reveals whether the currents of public air are pure or toxic. By that standard the present currents in Australia are noxious. They mark a change from the first generous response to the coronavirus to the meaner reconstruction of the economy.

The objections to the legislation focus correctly on the infringement of human rights. That phrase, however, is bloodless. It might suggest that rights form a list to be ticked off. Human rights are better conceived as a way of speaking about the conditions necessary for people to live decent human lives. The proper place from which to reflect on them is the actual lives of the people who are affected.

Some are trapped in immigration detention centres across the country in cramped and overcrowded conditions that make physical distancing impossible. Others are living in our community on temporary visas or no visas at all, struggling to make ends meet.

Nor is it necessarily lasting. Some people will be temporarily or lastingly paralysed by anxiety; others will be more resilient.

It is ironic for those of us who have long wished for a closer and more respectful relationship between India and Australia to be arguing now for caution. But perhaps the time has come for a relationship of political solidarity between the people of India and the people of Australia, rather than the economic expediency that seems to be on offer.

If we wish to persuade the public that a group of people is being treated unjustly, we portray them as innocent victims. We represent them as a class and as virtuous in order to change public opinion. Stories of violent behaviour by members of the group, however, reveal the reality that no group is uniformly composed of the virtuous and innocent.
