The continued persecution of Tamils has led to many fleeing Sri Lanka over the past ten years, with some landing on Australia’s shores — they have literally fled for their lives. The Australian government’s response to the inhumane treatment of refugees returned to Sri Lanka has been to praise the Sri Lankan government’s efforts to thwart any asylum seeker attempt to leave Sri Lanka.

On 17 April 2020, the Federal Court ordered that Immigration had failed to comply with procedural fairness for the family. The case is known by the pseudonym XAD. The XAD case relied on significant legal principles going back to the M61 High Court decision of 2011.

Last week the Federal Court granted an interim injunction to a child born in Australia preventing her removal from Australia. The case raises complex issues regarding the statutory bars preventing asylum seekers from even making any application at all, and the exercise of the ministerial discretion to lift that bar.

The students might not have many rights back home, but they do in the western democracies in which they live. The violence against peaceful protestors not just in Hong Kong but in countries where Hong Kong students are exercising their basic rights is unsettling. Yet the response by unis all over Australia has been taciturn at best.

Ensure the vulnerable people you 'manage' are hidden, demonised by politicians and right-wing commentators. Hire cheap labour, minimise your tax, and make millions.

Defence Minister Christopher Pyne recently called for an expansion of the Australian weapons industry. It would enable Australia to join the United States and Britain as a major exporter of weapons and further Australia’s strategic goals. The move has a logic: if you want weapons it is cheaper to make them than buy them; if you make them it is more profitable to sell them to others than to keep them all for yourself; if you sell them it is best to sell them to your friends.

I first met this Tony on my regular visits here to Darwin when he was working at the North Australian Aboriginal Legal Aid Service and then when he set up the mediation services under the auspices of Anglicare. In later years I knew him when he was your Anti-Discrimination Commissioner. He was a quiet, considered, gentle, strong and principled man. On Human Rights Day, it is only fitting that I honour Tony by offering some reflections on the architecture for human rights in Australia, on the contemporary human rights controversies, and on the way forward for better protection of the human rights of Aborigines and asylum seekers, two marginalised groups who had a special claim on Tony's sympathies.

'Tonight, gathered here in the Southern Cross Club in the national capital, gathered as Eureka's children. We affirm that there is room for everyone under the Southern Cross. I hope you will return to Canberra carrying the Southern Cross flag when we proclaim the Australia Republic on 1 January 2020 which will be two elections after Australia last had a monarchist leader of a major political party. Tony Abbott is the last of his type. Whether the prime minister honoured to witness the proclamation is Malcolm Turnbull, Bill Shorten or another matters not.'
